Custom Work Rates

Purpose

Establishing a Custom Work Policy ensures that municipal equipment and resources are available for all ratepayers of the municipality. In order to maintain consistency, rates should be set prior to the work taking place. The purpose of this policy is to outline Council's requirements for the undertaking of custom works by the municipality in accordance with the Municipal Act.

Scope

a) Custom works are not the core function of the municipality and will not take precedence over public works. Custom works will only be considered if the situation is deemed an emergency and detrimental to public safety.

b) In addition, customs works will only be considered if custom contractors or equipment are not available within the municipality to either supply the service or perform the work.

c) This policy applies to works and services carried outby the municipality on Custom property within the municipality. 

Procedures

1. The RM of Sifton encourages ratepayers to contact Custom operators.
2. The Municipality may enter agreements with other municipalities and/or Provincial/Federal agencies for Custom work and the rates to be charged will be in accordance with the Manitoba Heavy Construction Annual rates or as to be determined by both parties.
3. Requests for Custom Work to be done outside the physical boundaries of the Municipality are to be at the discretion of the whole of Council. Fuel surcharge may be applicable at the time of request if work location is outside the municipality.
4. All applications for Custom Works must be submitted to the Municipality by completing a Custom Works Application Form. See PDF
5. Council reserves the right to review and approve larger Custom works projects; however, the Municipal Foreman has approval authority for Custom Works applications.
6. The Municipality reserves the right to deny any application based on staffing, equipment, location and the work being requested.

Custom Work Rates

a) Rates charged for Custom Works are set at the current Manitoba Heavy Construction Association rates.

b) The rate per hour will increase in increments of 2% annually.

Mobile Dumpster Rental Rates

$ 250.00 per use

• Council decides if dumpster is emptied on site or if trailered to Waste Transfer Site on a “case by case” basis.
• The use of the mobile dumpster is limited to 1 week per customer.

Payment

a) The applicant will be invoiced for all Custom works undertaken by the Municipality at the rates mentioned above.

b) Payment is due upon receipt of invoice from the Municipality.

c) If payment is not received from the applicant within three (3) months of the invoice the Municipality reserves the right to collect the dull amount owing including penalties and a $20.00 administrative fee, acquired in the same manner as a tax may be collected or enforced under the Municipal Act.

Liability and Waiver

a) The applicant shall indemnify the Municipality and its employees, agents, councilors and contractors (the "Municipal Parties") from any and all liability, claims, demands, actions and causes of action from any claims, losses, damages, injury or illness of any nature arising out of or relating to the Custom Works.

b) The applicant may be required to sign a waiver as part of the agreement before the custom work is undertaken by the municipality.

c) The customer accepts any unpaid custom work fees will be applied to the associated property tax account.
